Fair Access Policy
WE MAINTAIN THE FOLLOWING FAIR ACCESS POLICY FOR ALL USERS OF OUR NETWORK AND SERVICES.
“We”, “us” and “our” refers to Latitude Wireless Inc. or Northwestel Inc. operating outside the Yukon as “Latitude Wireless”. “You” and “your” refers to all users of our services (the “Services”), whether or not you have an account or pay a monthly service fee to subscribe to the Services.
- Data Usage
- The amount of data transmitted over our network is measured in kilobytes (KB), megabytes (MB) or gigabytes (GB). We reserve the right to limit the amount of data transferred; and to deny, terminate, modify, disconnect or suspend Services if usage, at our discretion, is excessive and / or impedes the ability of others to access our network.
- We reserve the right to limit the amount of data transferred; and to deny, terminate, modify, disconnect or suspend Services if a device has been roaming off-network for more than 30 consecutive days.
- You may not use unlimited data plans and features in a manner that impedes the ability of others to access our network or use the Services.
- Data services may only be used for the following purposes:
- Internet browsing
- E-mail access
- Intranet access (including access to corporate intranets, e-mail, and individual productivity applications like customer relationship management, sales force, and field service work)
- Data plans and features may not be used for any other purpose. Examples of prohibited uses include, without limitation, the following:
- Continuous uploading, downloading or streaming of audio or video
- Server applications, such as automated data feeds, FTP servers and other file sharing applications
- As a substitute or backup for private lines or dedicated data connections
- Voice Usage
- The amount of voice usage transmitted over our network is measured in complete whole minutes. Latitude Wireless reserves the right to limit the amount of voice minutes utilized; and to deny, terminate, modify, disconnect or suspend Services if usage, at our discretion, is excessive and / or impedes the ability of others to access our network or Services.
- We reserve the right to limit the amount of voice usage utilized and to deny, terminate, modify, disconnect or suspend Services if a device has been roaming off-network for more than 30 consecutive days.
- You may not use unlimited voice plans and features in a manner that impedes the ability of others to access our network or use the Services.
- Services are provided solely for live dialogue between, and initiated by, two individuals. Unlimited voice plans and features are therefore prohibited from, but not limited to:
- Conference calling, monitoring services, data transmissions, transmission of broadcasts, transmission of recorded material, interconnection to other networks, telemarketing, autodialed calls, other commercial uses, or other connections that do not consist of uninterrupted live dialogue between two individuals.
- We will presume you are engaging in a prohibited use, in violation of the Fair Access Policy, if you are placing an abnormally high numbers of calls, or repeatedly placing calls of unusually long duration as compared to other customers on the same service plans, or if your usage is harmful or disruptive to our network or Services.
